When you decide to proceed with my representation, here is what you can expect:- I'll interview you to determine the best strategy for your specific facts and circumstances
- I’ll explain the different Chapters of the bankruptcy code, as well as which Chapter I feel best suits your specific case
- I'll advise you to proceed one of two ways: either under Chapter 7 of the bankruptcy code (liquidation) or under Chapter 13 of the bankruptcy code (reorganization)
- I'll quote you a flat fee for representation throughout the bankruptcy process in the form of a written retainer agreement
- I’ll retrieve your credit report and assist you in gathering all the materials we will need (paycheck stubs, tax returns, bank statements, etc.)
- I'll draft your bankruptcy petition per your specific assets and liabilities as well as list all creditors to be notified and thereafter halted from contacting you any further about your debts per the automatic stay
- I'll electronically file your petition in the proper district (federal court) which will put an immediate stop to garnishments, collections, and foreclosure and in all likelihood allow you to keep many of your assets including, but not limited to, your paycheck, car, and home
- I’ll advise you on how to complete the credit counseling requirement (before we file) so you will be in compliance with the bankruptcy code
- I’ll advise you on how to complete the debtor education course requirement (after we file) so you will be in compliance with the bankruptcy code
- I'll provide you with the document production form which must be completed and returned to the trustee assigned to your case prior to your appearance at the federal courthouse
- I'll communicate with the trustee assigned to your case to insure he or she has everything they need, both before and after your appearance at the federal courthouse
- I'll appear with you at your 341 meeting of creditors at the federal courthouse, you will always have a lawyer by your side from beginning to end
